Definitions
Customer: any professional or natural person with legal capacity within the meaning of articles 1123 et seq. of the French Civil Code, or legal entity, who visits the Site covered by these general terms.
Content: all the elements making up the information on the Site, including text, images and videos.
Customer information: hereinafter “Information”, this means all the personal data that hedontechnologies.com may hold for customer relationship management and for analysis and statistical purposes.
User: an internet user who connects to and uses the aforementioned site.
Personal information: “information which allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies” (article 4 of French law no. 78-17 of 6 January 1978).
The terms “personal data”, “data subject”, “processor” and “sensitive data” have the meaning defined by the General Data Protection Regulation (GDPR no. 2016-679).
1. Presentation of the website
Pursuant to article 6 of French law no. 2004-575 of 21 June 2004 on confidence in the digital economy, users of the hedontechnologies.com website are informed of the identity of the various parties involved in its creation and monitoring:

2. General terms of use of the site and the services offered
The Site is an intellectual work protected by the provisions of the French Intellectual Property Code and applicable international regulations. The Customer may under no circumstances reuse, assign or exploit for their own account all or part of the Site’s elements or works.
Use of the hedontechnologies.com site implies full and unreserved acceptance of the general terms of use described below. These terms may be amended or supplemented at any time; users are invited to consult them regularly.
This site is normally accessible at all times. An interruption for technical maintenance reasons may nevertheless be decided by Hedon, which will endeavour to communicate the dates and times of the intervention in advance.
3. Description of the services provided
The purpose of the hedontechnologies.com website is to provide information about all of the company’s activities. Hedon endeavours to provide information that is as accurate as possible, but cannot be held liable for omissions, inaccuracies or failures to update, whether caused by Hedon or by third-party partners.
All the information on the site is provided for guidance only and is subject to change, subject to modifications made since it was put online.
4. Contractual limitations on technical data
The site uses JavaScript technology. It cannot be held liable for material damage linked to its use. The user undertakes to access the site with recent, virus-free equipment and an up-to-date browser.
The hedontechnologies.com site is hosted by a provider located within the European Union, in accordance with the provisions of the GDPR (no. 2016-679). The host ensures continuity of its service 24 hours a day, every day of the year, and reserves the right to interrupt the service for the shortest possible periods, in particular for maintenance purposes.
Hedon and the host cannot be held liable in the event of a malfunction of the Internet network, telephone lines or computer equipment, in particular due to network congestion preventing access to the server.
5. Intellectual property and counterfeiting
Hedon owns the intellectual property rights and holds the rights of use on all elements accessible on the site, including texts, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication or adaptation of all or part of these elements, by any means, is prohibited without the prior written authorisation of Hedon.
Any unauthorised use of the site or of any of the elements it contains will be considered an infringement and prosecuted in accordance with articles L.335-2 et seq. of the French Intellectual Property Code.
6. Limitations of liability
Hedon acts as the publisher of the site and is responsible for the quality and accuracy of the content it publishes.
Hedon cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing the site, resulting either from the use of equipment that does not meet the specifications set out in point 4, or from the appearance of a bug or an incompatibility. Hedon also cannot be held liable for indirect damage resulting from use of the site.
A contact area is available to users. Hedon reserves the right to delete, without prior notice, any content posted in this area that contravenes the legislation applicable in France.
7. Personal data management
The Customer is informed of the regulations concerning marketing communications (French law of 21 June 2004 on confidence in the digital economy), the French Data Protection Act of 6 August 2004, and the GDPR (no. 2016-679).
7.1 Controller for the collection of personal data
For personal data collected as part of browsing the Site, the data controller is Hedon Technologies. As data controller, Hedon undertakes to comply with the legal provisions in force and to take all reasonable measures to ensure the accuracy and relevance of the data with regard to the purposes for which they are processed.
7.2 Purpose of the data collected
Hedon may process all or part of the data:
- to enable browsing of the Site and the management of the services and benefits ordered (connection data, history);
- to prevent and combat computer fraud (equipment used, IP address, hashed password);
- to improve browsing on the Site;
- to conduct optional satisfaction surveys (email address);
- to run communication campaigns (telephone number, email address).
Hedon does not sell your personal data, which is used only where necessary or for statistical and analytical purposes.
7.3 Right of access, rectification and objection
In accordance with the European regulations in force, users have the following rights: right of access and rectification (articles 15 and 16 GDPR), right to erasure (article 17), right to withdraw consent (article 13-2c), right to restriction of processing (article 18), right to object (article 21), right to data portability (article 20), and the right to define what happens to their data after death.
To exercise these rights, the user may contact Hedon in writing at the following address: Hedon Technologies — DPO, Vincent Mirailles, 35 avenue Marcel Dassault, 31500 Toulouse, France. The request must specify the data concerned and be accompanied by a copy of an identity document.
Users may also lodge a complaint with the CNIL.
7.4 Non-disclosure of personal data
Hedon undertakes not to process, host or transfer the information collected to a country located outside the European Union or recognised as “non-adequate” by the European Commission without first informing the customer. Hedon remains free to choose its subcontractors, provided they offer sufficient guarantees with regard to the GDPR.
Hedon undertakes to take all necessary precautions to preserve the security of the information. In the event of an incident affecting its integrity or confidentiality, Hedon will inform the Customer as soon as possible and communicate the corrective measures taken. Hedon does not collect any sensitive data.
8. Incident notification and security
Whatever efforts are made, no method of transmission over the Internet or electronic storage is completely secure. In the event of an identified security breach, Hedon will notify the users concerned so that they can take appropriate measures, in accordance with its national and European legal obligations.
No personal information is published without the user’s knowledge, exchanged, transferred, assigned or sold to third parties. Only in the event of a takeover of Hedon could this information be transferred, under the same obligation of retention towards the user.
To ensure the security and confidentiality of data, Hedon uses standard measures such as firewalls, pseudonymisation, encryption and passwords.
9. Hyperlinks and cookies
The hedontechnologies.com site may contain hyperlinks to other sites. Hedon is unable to verify the content of the sites visited in this way and accepts no responsibility in this regard.
A “cookie” is a small information file sent to the user’s browser and stored on their device. It includes information such as the domain name, the internet service provider, the operating system, and the date and time of access. Cookies cannot in any way damage the user’s device.
The user can configure their browser to accept or refuse cookies, systematically or according to their sender. If cookies are refused, browsing and the experience on the Site may be limited. At any time, the user can change their cookie choices from their browser settings.
10. Applicable law and jurisdiction
Any dispute relating to the use of the hedontechnologies.com site is subject to French law. Except where the law does not permit it, exclusive jurisdiction is granted to the competent courts of Toulouse.
